EOS Worldwide Privacy Notice

We may provide you with access to certain EOS Worldwide systems, programs, products, and other intellectual property, which include (i) websites (including www.eosworldwide.com and https://rocketfueluniversity.com), software (including EOS One™), platforms, subscriptions, memberships, applications (including mobile applications), tools, and content that we may provide or make available from time-to-time; (ii) email and network systems and accounts; (iii) client management platforms, wireless high-speed Internet access systems; and  (iv) e-commerce (such as our EOS Online Store) and promotions (collectively, the “EOS Web Properties”).  

This EOS Worldwide Privacy Notice (this “Privacy Notice”) describes the personal information that EOS Worldwide, LLC, a Michigan limited liability company and its applicable EOS affiliated entities (“EOS Worldwide”, “we”, “us”, “our”) collect when you interact with us through all of our EOS Web Properties that display or link to this notice or through offline services, how we use it, with whom we share it, how long we retain it, and your choices in connection with it.

This Privacy Notice does not apply to information collected by any third party, including through any application or content (including advertising) that may link to or be accessible from or through the EOS Web Properties, unless such information is shared with us for the purposes we describe below.  Once you leave our EOS Web Properties, you will be subject to third party terms and conditions and privacy policies.  

This Privacy Notice is incorporated by reference into the EOS Worldwide General Terms of Use (“General Terms”).   The General Terms (as supplemented by this Privacy Notice (collectively defined as our “Terms and Conditions”)) govern your access to and use of the EOS Web Properties, and, as a result, you should read this Privacy Notice and the General Terms carefully before accessing or using any EOS Web Property or sharing any personal information with us. Capitalized terms used herein and not otherwise defined shall have the meaning set forth in the General Terms.

This Privacy Notice may change from time to time. Your continued use of our EOS Web Properties after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.

COLLECTION AND USE OF YOUR PERSONAL INFORMATION

We collect personal information, which is any information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, to you, when you engage with EOS Worldwide, and as applicable, our EOS Web Properties. Specifically, at times, we collect personal information directly from you and at times, we collect personal information automatically as you engage with our EOS Web Properties, each as described below.  

We may collect, store or process several types of information from and about users of our EOS Web Properties including information:

  • by which you may be personally identified, such as name, postal address, email address, telephone number, visual information (e.g., photograph, if provided), or other identifiers by which you may be contacted online or offline (“personal identifiers”);
  • that is about you but individually does not identify you, such as date of birth, gender and marital status (“other personal information”);
  • that is considered sensitive information, such as Social Security or other state identification number (only under limited circumstances); geolocation; racial or ethnic origin, religious or philosophical beliefs (“sensitive personal identifiers“);
  • that is about your professional history or experiences, such as your resume, cover letter, educational history, employment history, professional affiliations, role or title, company information and specialized certifications (“professional or employment-related information”);
  • should you provide it, that we may use to process payments, such as credit card and debit card information (“payment information”)
  • that is used to access your account on any of our EOS Web Properties (“account information”); and
  • about your internet or other electronic network activity, such as IP address, location information based on the IP address, Internet connection, date and time of the server request, device and browser data, time zone, specific browser or app function, access status, amount of data transferred, log data, operating system used, and its interface (e.g., Android or IOS), language, version of the operating system, device identifiers, and other usage details (“internet or other electronic network activity information”)

We collect this information:

  • directly from you when you provide it to us;
  • automatically as you navigate through our EOS Web Properties (information collected automatically may include usage details, IP addresses, and information collected through cookies, web beacons, pixels, and other tracking technologies); and
  • from third parties, for example, our business partners and service providers.

(A) Information Collected Directly From You

The information we collect on or through our EOS Web Properties may include:

  • information that you provide by filling in forms on our websites and other EOS Web Properties. This includes information provided at the time of registering to use our EOS Web Properties, subscribing to our services, posting material, or requesting further services. We may also ask you for information when you enter a contest or promotion sponsored by us, and when you report a problem or request support from us. 
  • records and copies of your correspondence (including email addresses), if and when you contact us.
  • your responses to surveys or other assessments that we might ask you to complete for research type purposes.
  • details of transactions you carry out through our EOS Web Properties and of the fulfillment of your orders. You may be required to provide payment information before placing an order through our EOS Web Properties or when signing up for event or a class.
  • your search queries on our EOS Web Properties.

You also may provide information to be published or displayed (hereinafter, “posted”) on public areas or semi-public areas accessible to certain members of our EOS Worldwide communities, or transmitted to other users of our EOS Web Properties or third parties (collectively, “User Contributions”). Your User Contributions are posted on and transmitted to others at your own risk. Although we limit access to certain pages, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons. 

Here are some examples of when we collect personal information directly from you when you: 

  • Apply for employment. If you apply for employment with EOS Worldwide, we will collect your personal identifiers, other personal information, certain sensitive personal identifiers, and your professional or employment-related information. We use this personal information to assess and manage your application and to communicate with you about your application. For more information on how we handle California applicants’ personal information, please see our EOS Worldwide California Applicant Privacy Notice.
  • Attend one of our events. If you register to attend one our EOSW Events (such as an EOS Conference™, a QCE™ (Quarterly Collaborative Exchange™), a QIE™ (Quarterly Integrator Exchange™), a Rocket Fuel™ Masterclass, or a Great Boss™ Workshop), we may collect your personal identifiers, certain other personal information, certain sensitive personal identifiers, and certain professional or employment-related information, and if you provide it, your payment information. We may collect this information directly or you may be directed to our third-party providers that help us manage registrations. Once you leave our website, you will be subject to their terms and conditions and privacy policy. We collect all the registration information, besides the payment information, from our third-party event providers. We use this information to create and manage the event (e.g., to create and manage the guest list, accreditation and admission control, room and personnel planning, planning the catering), provide you access, communicate with you regarding the event, and to send you marketing information. We may also use this information for prevention of fraud and defense against legal claims. 
  • Become an EOS Implementer®. If you wish to become an EOS Implementer, you will need to complete an application. We collect from you your personal identifiers, certain other personal information, sensitive personal identifiers, your professional or employment-related information and have you answer a series of questions related to your desire to become an EOS Implementer.  You will also speak with our sales team and others within EOS Worldwide to learn more about the EOS Implementer opportunity or register for an on-demand or live webinar. We may record these calls, however if we do you will be informed before the recording begins.  We use this information to communicate with you regarding the opportunity, provide you with access to our webinars, to set up informational calls, for training purposes and to assess whether you are qualified to become an EOS Implementer.  Once you become an EOS Implementer, we will collect and maintain your personal identifiers, your other personal information, your sensitive personal identifiers your professional or employment-related information and your payment information.  We use this information to communicate with and support our EOS Implementer Community, process your fees under your franchise/implementer agreement with us, and to send you other information as an EOS Implementer. We may also use this information for prevention of fraud and defense against legal claims. In addition, your image, audio and/or video may be captured and used in our marketing efforts.
  • Find an EOS Implementer. If you wish to use the find an EOS Implementer feature on our EOS Web Properties, you will fill out an online form. We will collect from you your personal identifiers and your professional or employment-related information. We use this to schedule an introductory call to speak with our Warm Leads team and possibly others within EOS Worldwide, and to help us connect you with an EOS Implementer, communicate with you regarding your call, and to communicate with you regarding our products and services and EOS®.  We may record these calls, however if we do you will be informed before the recording begins.
  • Create a company account. If you create a company or business account with us (including through our EOS One™ Software or EOS One™ Practice Management, Base Camp, or within Rocket Fuel University®), we will collect your personal identifiers and your professional or employment-related information. You will need to create a username and password to access your account. Once your account is created, we will store your username and password in a hashed format. You may also choose to subscribe to our mailing lists, blogs and other marketing materials at this time (and you may unsubscribe at any time by clicking the link at the footer of each email we send you). We use account information and this other personal information to create and manage your account, provide you with the products and tools you signed up for, track your progress, process your payment, and to communicate with you regarding our services.
  • Create an individual account. If you create an individual account with us (including through our EOS One™ Software or EOS One™ Practice Management, Base Camp, or within Rocket Fuel University®), we will collect your personal identifiers and certain professional or employment-related information.  Once your account is created, we will store your username and password in a hashed format. You may also choose to subscribe to our mailing lists, blogs, and other marketing materials at this time (and you may unsubscribe at any time by clicking the link at the footer of each email we send you). We use this account information and this other personal information to create and manage your account, provide you with the products and tools you signed up for, track your progress, and to communicate with you regarding our services.  If you elect to do so within your account, we may also use this personal information to facilitate your use of certain functionalities within your account. We may supplement the information that we receive from you with other aggregated information that we get from third-party sources to enrich your profile so that we can tailor our marketing communications in accordance with your interests as inferred from your information. 
  • Contact us. When you send us a question or inquiry, use the chat function if available on any of our EOS Web Properties, or ask for other support, you will need to provide us with personal identifiers and possibly your account information under certain circumstances. We use this personal information to respond to your questions or inquiries, troubleshoot where necessary, and address any issues you have with our services or EOS Web Properties.  We may record these calls, however if we do you will be informed before the recording begins.  
  • Host an event. EOS Implementers are permitted to host certain EOS events from time to time. If you host an EOS event, we may collect your personal identifiers and if applicable, payment information. We use this personal information to help you manage your event and to process your payments, as applicable.  
  • Interact with our Community Message Boards. If you interact and post on our community message boards (e.g., EOS Pulse), we will collect your personal identifiers as well as any information that you provide when interacting with these message boards by commenting, sharing and rating. We use this information to advertise our products, for events and invitations, to help support our EOS Worldwide communities, to facilitate communications and engagement between other members of the EOS Worldwide community, and to communicate with users via the contribution and comment function. 
  • Order From the EOS Online Store. If you choose to purchase any products or materials from our EOS Online Store, we may collect your personal identifiers. We may collect this information directly or you may be directed to our third-party providers that help us manage our online sales. Once you leave our website, you will be subject to their terms and conditions and privacy policy. We collect all the purchase information, besides the payment information, from our third-party event providers. We use this information to fulfill your purchase (e.g., inventory management, shipping your purchase to you, etc.), and communicate with you regarding your purchase.  You may also choose to subscribe to our mailing lists, blogs, and other marketing materials at this time (and you may unsubscribe at any time by clicking the link at the footer of each email we send you). We may also use this information for prevention of fraud and defense against legal claims. 
  • Subscribe to our EOS Blogs. If you subscribe to our blogs for updates, news, and special offers, we will collect your personal identifiers. We use this personal information to send you updates, news, and special offers as requested. You may unsubscribe at any time by clicking the link at the footer of each email we send you. Our emails include a tracking pixel that tracks whether you open the email and whether you click banners in the email and your subsequent clicks and usage of our website. We use this information to send you additional email communications which may be of interest to you based on your interaction with our emails and/or websites. You can avoid downloading the pixel by rejecting the download of images in the email.
  • Interact with us on social media. When you interact with our fan page on social networking websites, such as Meta (including its platforms, such known as Facebook and Instagram), Twitter, and LinkedIn (each a “Page” and collectively “Pages”), we may collect basic engagement metrics and use it to tailor content and marketing and to improve user experience as set forth in this section. Please understand that we do not control the use or storage of the information that you have posted to any third-party social networking websites. This information is collected and processed by the social networking websites for their own purposes, including marketing.   • Pages. When interacting with our Pages, we may collect from you, your personal identifiers as well as any information that you provide when interacting with our Pages (e.g., commenting, sharing and rating). We use this information to advertise our products, for events and invitations, and to communicate with users via the contribution and comment function. 

Because our Pages are publicly accessible, when you use them to interact with other users, for example by posting, leaving comments or liking or sharing posts, any personal information that you post in them or provide when registering can be viewed by others or used by them as they see fit.

The content posted on our Pages or other public areas of social networking websites can be deleted in the same way as other content that you have created. If at any time you want content posted to be deleted, please email your request to [email protected]

  • Community Management. With the help of a third party, we may collect, from you, your contact, including “likes”, shares, messages and other interactions with the content, in order to analyze and evaluate how our content is perceived, to learn from it, and to improve our public relations efforts. We may use this information to create advertisements that match our Fan Pages and to disseminate them via Facebook based on demographic data. 
  • Surveys. When you participate in a survey on our Facebook Page, we collect, from you, your personal identifiers, your internet or other electronic network activity information, and metadata (usage patterns). We use this information to analyze and process the results of our surveys for market research purposes. 
  • Aggregate data. We aggregate the data we collect for benchmarking purposes and for internal analytics.

We may also use the personal information we collect as described in this section to comply with the law, to efficiently maintain our business, and for other limited circumstances as described below in HOW WE SHARE YOUR PERSONAL INFORMATION.  

(B) Information Collected Automatically

As you navigate through and interact with our EOS Web Properties, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

  • details of your visits to our EOS Web Properties, including traffic data, location data, logs, and other communication data and the resources that you access and use with our EOS Web Properties.
  • Information about your computer and internet connection, including your IP address, operating system, and browser type.

The information we collect automatically may include personal information, but we may maintain it or associate it with personal information we also collect in other ways or receive from third parties. It helps us to improve our EOS Web Properties and to deliver a better and more personalized service, including by enabling us to:

  • Track you within the EOS Web Properties.
  • Estimate our audience size and usage patterns.
  • Store information about your preferences, allowing us to customize our EOS Web Properties according to your individual interests and enhance your user experience.
  • Speed up your searches.
  • Conduct analytics to improve the EOS Web Properties.
  • Recognize you when you return to our EOS Web Properties.
  • Prevent fraudulent use of the EOS Web Properties.
  • Diagnosis and repair errors, and, in cases of abuse, track and mitigate the abuse. 
  • Market to you more effectively across different web pages and social media platforms based on your browsing habits and history.

The technologies we use for this automatic data collection may include:

  • Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of our EOS Web Properties. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our EOS Web Properties. 
  • Web Beacons. Pages of our EOS Web Properties may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit EOS Worldwide, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity).

Our use of Cookies and other Tracking Technologies when you Interact with the EOS Web Properties. 

We use necessary (essential), functionality, measurement (analytics), marketing (advertising (targeting)), and experience cookies to collect your usage, device, and location information when you interact with the EOS Web Properties. Third party marketing and analytics cookies may be considered sharing under the California Privacy Rights Act (CPRA). One particular third-party cookie to note that we use on our EOS Web Properties: Google Analytics (please see below for more information regarding how we use Google Analytics). Some content or applications, including advertisements, on our EOS Web Properties are served by third parties, including advertisers, ad networks and servers, content providers, and application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use our EOS Web Properties. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly. For information about how you can opt out of receiving targeted advertising from many providers, see the section  below titled YOUR INFORMATION CHOICES.

As noted above, we use Google Analytics to collect information on your use of our EOS Web Properties to improve our websites and mobile applications. In order to collect this information, Google Analytics may set cookies on your browser or read cookies that are already there. Google Analytics may also receive information about you from applications you have downloaded that partner with Google. We do not combine the information collected through the use of Google Analytics with personal information. Google’s ability to use and share information collected by Google Analytics about your visits to our EOS Web Propertiesor to other applications which partner with Google is restricted by the Google Analytics Terms of Use and Privacy Notice. To prevent your data from being used by Google Analytics, you can download the Google Analytics opt-out browser add-on and/or follow the instructions in the YOUR INFORMATION CHOICES section below.

HOW WE USE YOUR INFORMATION

We use information that we collect about you or that you provide to us, including any personal information:

  • To present our EOS Web Properties and their contents to you.
  • To provide you with information, products, or services that you request from us.
  • To fulfill any other purpose for which you provide it.
  • To provide you with notices about your account or subscription, including expiration and renewal notices.
  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.
  • To notify you about changes to our EOS Web Properties or any products or services we offer or provide though it.
  • To allow you to participate in interactive features on our EOS Web Properties.
  • In any other way we may describe in this Privacy Notice or when you provide the information.
  • For any other purpose with your consent.

We may also use your information to contact you about our own and third-parties’ goods and services that may be of interest to you. For more information, see YOUR INFORMATION CHOICES below.

We may use the information we have collected from you to enable us to display advertisements to our advertisers’ target audiences. Even though we do not disclose your personal information for these purposes without your consent, if you click on or otherwise interact with an advertisement, the advertiser may assume that you meet its target criteria.

HOW WE SHARE YOUR PERSONAL INFORMATION 

General Sharing 

We may need to make personal information identified in this Privacy Notice available within EOS Worldwide, with service providers, EOS Implementers, or with other third parties as set forth below.  We may also disclose aggregated information about our users, and information that does not identify any individual, without restriction. 

Within EOS Worldwide. We may share your personal information with our affiliates, employees, agents, and representatives for legitimate business purposes, general business management, and as permitted by law. We may also share your personal information with our affiliates, employees, agents, and representatives for marketing purposes. If you are a California resident and wish to opt out, please follow the instructions in the YOUR INFORMATION CHOICES section. 

With EOS Implementers.  We may share your personal information with our EOS Implementers and their affiliates, employees, agents and representatives for legitimate business purposes, general business management, and as permitted by law, including, if you use the “Find an Implementer” feature on our EOS Web Properties. We may also share your personal information with our EOS Implementers and their affiliates, employees, agents, and representatives for marketing purposes.  If you are a California resident and wish to opt out, please follow the instructions in the YOUR INFORMATION CHOICES section.

With Contractors or Service Providers.  We may share your personal information with our or our EOS Implementers’ service providers that assist us in providing EOS products or services or otherwise support our businesses. These service providers include payment processors, cloud service providers, online form providers, ticketing providers, communications vendors, website providers, marketing providers, shipping providers, payment processors, and online scheduling providers.

With Other Third Parties. We may need to disclose your personal information to third parties, such as legal advisors, law enforcement agencies, or governmental/regulatory bodies in order to comply with any court order, law, or legal process, including to respond to any government or regulatory request, to enforce or protect our legal interests and other rights under our agreements or otherwise, to protect against fraud or other illegal activities, prevent harm, for risk management purposes, and to comply with our legal obligations.  This may include exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

In the Event of a Corporate Reorganization. In the event that we enter into, or intend to enter into, a transaction that alters the structure of our business, such as a reorganization, merger, acquisition, sale, joint venture, assignment, consolidation, transfer, change of control, or other disposition of all or any portion of our business, assets or stock, we would share personal information with third parties, including the buyer or target (and their agents and advisors) for the purpose of both facilitating and completing the transaction and for the buyer’s operation of our businesses as a going concern following the completion of the transaction in which personal information held by us about our users is among the assets transferred. We would also share personal information with third parties if we undergo bankruptcy or liquidation, in the course of such proceedings. 

To Fulfill The Purpose For Which You Provide It. For example, if you give us an email address to use the “Find an Implementer” feature of our website, we will transmit the contents of that email and your email address to the recipients.

With Your Consent. Apart from the reasons identified above, we may request your permission to share your personal information for a specific purpose. We will notify you and request consent before we provide the personal information or before the personal information you have already provided is shared for such purpose. You may revoke your consent at any time.  This may include to third parties to market their products or services to you. We contractually require these third parties to keep personal information confidential and use it only for the purposes for which we disclose it to them. Sharing in the Last Twelve (12) Months 

For a Business Purpose. In the preceding twelve (12) months, we have disclosed the following categories of personal information for a business purpose to the following categories of third parties: 

  • We have disclosed your personal identifiers, internet or other electronic network activity information, and customer records information to service providers that perform services on our behalf. These service providers include our payment processors, ticketing providers, communications vendors, ecommerce platform providers (i.e., the EOS Online Store), marketing providers, website hosting providers, and analytics providers.
  • We have disclosed your internet or other electronic network activity information to our IT support to detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, and to identify and repair website errors that impair functionality. 
  • We have disclosed your internet or other electronic network activity information and location information to our IT support and data analytics provider to maintain, improve, and upgrade our EOS Web Properties. 

For a Sale or Sharing. 

  • We use certain analytics and advertising cookies on our EOS Web Properties. These cookies collect your internet and other electronic network activity and share it with the data analytics and advertising partners that provide them. This use of your personal information may be considered a sale under the California Consumer Privacy Act or, effective January 1, 2023, sharing under the California Privacy Rights Act. If you are a California resident and wish to opt out of these cookies, please follow the instructions in the YOUR INFORMATION CHOICES section.  We share your personal identifiers and commercial information with advertising partners to engage in lookalike advertising.   • We share your personal identifiers with our affiliates, employees, agents, representatives, and EOS Implementers for marketing purposes. If you are a California resident and wish to opt out of this sharing, please follow the instructions in the YOUR INFORMATION CHOICES section below.
  • We share your personal identifiers for marketing purposes with certain business partners (which include venues hosting events for which you purchase the tickets for our events). If you are a California resident and wish to opt out of this sharing, please follow the instructions in the YOUR INFORMATION CHOICES section below.

YOUR INFORMATION CHOICES

We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information:

  • Correct or View Your Information. You may access your account within our applicable EOS Web Properties to correct or view certain personal information you have provided to us and which is associated with your account. 
  • Opt Out of Advertising Cookies. To set your cookie preferences or opt out of the sale or sharing of your information via cookies, please visit Do Not Sell or Share My Personal Information. All session cookies are temporary and expire after you close your web browser. Persistent cookies can be removed by following your web browser’s directions. To find out how to see what cookies have been set on your computer or device, and how to reject and delete the cookies, please visit: https://www.aboutcookies.org/. Please note that each web browser is different. To find information relating to your browser, visit the browser developer’s website and mobile application. If you reset your web browser to refuse all cookies or to indicate when a cookie is being sent, some features of our website may not function properly. If you choose to opt out, we will place an “opt-out cookie” on your device. The “opt-out cookie” is browser specific and device specific and only lasts until cookies are cleared from your browser or device. The opt-out cookie will not work for essential cookies. If the cookie is removed or deleted, if you upgrade your browser or if you visit us from a different computer, you will need to return and update your preferences. We do not control third parties’ collection or use of your information to serve interest-based advertising. However these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (NAI) on the NAI’s website.

YOUR STATE PRIVACY RIGHTS 

State consumer privacy laws may provide their residents with additional rights regarding our use of their personal information.  For example, residents of California, Connecticut, Colorado, Nevada, Utah, and Virginia may have additional personal information rights and choices. To learn more about consumer privacy rights in these states and how to exercise them, please see below.

RIGHTS OF CALIFORNIA RESIDENTS

The California Privacy Rights Act (CPRA) entitles California residents to certain rights. To the extent the CPRA applies to our processing of your personal information, you are entitled to the following rights:

  • Right to Access/Know. You have the right to request what personal information we have collected, used, disclosed, and sold about you, unless doing so proves impossible or would involve disproportionate effort. You may only make a request for access twice within a 12-month period. To exercise your right to access your personal information, you may submit a request by following the instructions below. 
  • Right to Deletion. You have the right to request the deletion of your personal information that we collect or maintain, subject to certain exceptions. For example, if we are required by law to retain the information that you are asking to be deleted, we would not be able to delete the information until we are legally permitted to delete it. To exercise your right to delete your personal information, you may submit a request by following the instructions below. 
  • Right to Opt Out of Sale/Sharing. You have the right to opt out of the sale or sharing of your personal information to third parties. We do not have actual knowledge that we sell or share personal information of minors under the age of sixteen (16) years. To exercise your right to opt out of the sale or sharing of your personal information, you may submit a request by following the instructions below. 
  • Right to Non-Discrimination. You have the right to not receive discriminatory treatment if and when you exercise your rights to access, delete, opt out, correct, or limit use of sensitive personal information (as defined below) under the CPRA. 
  • Right to Correct: You have the right to correct inaccurate personal information that we collect or maintain. You can exercise this right by logging into your EOS Worldwide account and updating the information on your account, or by following the instructions below. 
  • Right to Limit Use of Sensitive Personal Information: Sensitive personal information is defined under the CPRA as personal information that reveals (a) consumer’s Social Security or other state identification number; (b) a consumer’s account log-in, financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account; (c) consumer’s geolocation; (d) consumer’s racial or ethnic origin, religious or philosophical beliefs, or union membership; (e) the contents of a consumer’s mail, email, or text messages, unless the business is the intended recipient of the communication; and (f) consumer’s genetic data. Examples include, but are not limited to, driver’s license number, biometric information, and precise geolocation. You have the right to limit the use of your sensitive personal information when such use goes beyond that which is necessary for providing our products and services to you, the EOS Web Properties, or for certain other permissible purposes like fraud, customer service or quality control. We do not use sensitive personal information collected through the EOS Web Properties in this manner.

For requests submitted, you must provide us with sufficient information that allows us to reasonably verify your identity, as well as the right you are exercising. This information includes your name, email address, physical address, and please indicate the nature of your relationship with EOS Worldwide (customer, EOS implementer, etc.). For email submissions, please write, “California Privacy Request,” in the subject of the email. 

The information you provide allows us to reasonably verify you are the person about whom we collected the personal information and describe your request with sufficient detail to allow us to properly evaluate and respond to it. In doing so, we will take steps to verify your request by matching information provided by you with the information we have in our records. If we are not able to verify your identity for access and deletion requests with the information provided, we may ask you for additional pieces of information. 

Only you, or a person that you authorize to act on your behalf may make a request related to your personal information. If you are an authorized agent making a request on behalf of another individual, you must provide us with signed documentation that you are authorized to act on behalf of that individual. RIGHTS OF CONNECTICUT, COLORADO, VIRGINIA AND UTAH RESIDENTS 

The Connecticut Data Privacy Act (CTDPA), the Colorado Privacy Act (CPA), the Virginia Consumer Data Protection Act (CDPA), and effective as of December 31, 2023, the Utah Consumer Privacy Act (UCPA), entitle residents of Connecticut, Colorado, Virginia, and as of December 31, 2023, Utah, respectively, with certain rights. If we deny your request, you may submit an appeal. To submit an appeal, please email [email protected] and provide, in detail, the contents of your original request, the reason the request was denied, a detailed explanation on why the request should be granted, and any other information you wish for us to consider. Please use the subject line “Consumer Right Appeal Request” and please indicate which state you are exercising this appeal under. For example, “Virginia Consumer Right Appeal Request.” 

If we fail to reverse our decision, we will provide you with the proper contact information to file a complaint with the appropriate Attorney General. 

NEVADA RESIDENTS 

If you are a consumer in the State of Nevada, you may request to opt out of the current or future sale of certain of your personal information. We do not currently sell any of your personal information under Nevada law, nor do we plan to do so in the future. RIGHTS OF CANADIAN CITIZENS 

Citizens of Canada are entitled to certain rights under The Personal Information Protection and Electronic Documents Act in Canada (PIPEDA).  If our processing of your personal information is subject to PIPEDA, you may be entitled to the following rights: 

  • Right to lodge a complaint: You have the right to lodge a complaint directly to us regarding our alleged noncompliance with PIPEDA. We will review and respond to your complaint. PIPEDA-related complaints can be directed to [email protected].
  • Right to access: You have the right to ask us for copies of your personal information. This right has some exemptions, which means you may not always receive all the personal information we process. Applicable exemptions may include the management information exemption (data that we process for management forecasting or management planning about a business or other activity), confidential references (references given or received about an individual), or certain instances of ongoing or prior negotiations with the requestor, among others.   
  • Right to rectification: You have the right to ask us to rectify personal information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete.
  • Right to erasure: You have the right to request erasure of your personal information that we are not obligated to keep in some cases (also known as the right to be forgotten).  For example, you can request us to delete such personal data if:  (i) we no longer need the data for the purpose it was collected for, (ii) we process the data based on your consent and you revoke your consent, (iii) you object to our processing based on legitimate interest (and we do not have an overriding legitimate interest), or (iv) you object to our processing the personal data for direct marketing purposes.  We may not be able to immediately erase your personal information if we have a lawful reason or a legal or contractual obligation to retain the information or continue the processing.  
  • Right to restrict processing: If you believe that your personal data is inaccurate, that our processing is unlawful, or that we do not need the information for a specific purpose, you have the right to request that we restrict the processing of such personal data. You also have the possibility to request that we stop processing your personal data while we assess your request. If you object to our processing (per your right to object below), you may also request us to restrict processing of that personal data while we make our assessment.
  • Right to object to processing: You have the right to object to processing of your personal data which is based on our legitimate interest by referencing your personal circumstances. You also have the right to object to our use of your personal data for direct marketing purposes. When you object to our use of your data for direct marketing purposes (i.e., let us know that you no longer wish to receive direct marketing from us), we will stop sending you direct marketing correspondence.
  • Right to data portability: This right only applies to personal information you have given us. You have the right to ask that we transfer the personal information you gave us from one organization to another or give it to you.
  • Automated Processing: You have the right to not be subjected to solely automated processing of your data in a way which will have a material impact on you. 
  • Rights under Quebec 64: If you are a resident of Quebec, you have some additional rights as described below: 
  • Decisions based on automated processing. If we use your personal information to render decisions based exclusively on automated processing, you have the right to be informed of this at or before the time of the decision. 
  • De-indexation and cessation of dissemination.  Under certain circumstances, you have the right to request we cease disseminating personal information or de-index any hyperlink that provides access to this information by a technological means. You have this right when dissemination would violate the law, violate a court order, or cause serious injury to your privacy or reputation. 
  • Right to request source of information.  Where we collect your personal information from another person or entity (i.e., not you), you may request us to inform you of the source of the data.

RIGHTS OF CITIZENS OF THE EUROPEAN UNION 

Citizens of the European Union are entitled to certain rights under the General Data Protection Regulation (GDPR). If our processing of your personal information is subject to the GDPR, you may be entitled to the following rights:

RIGHTS OF AUSTRALIAN CITIZENS

Citizens of Australia are entitled to certain rights under the Australia Privacy Act 1988 (Australia Privacy Act). If our processing of your personal information is subject to the Australia Privacy Act, you may be entitled to the following rights:

  • Right to know: You have the right to know why your personal information is being collected, how it will be used, and who it has been disclosed to. 
  • Right of using a pseudonym: You have the right to have the option of not identifying yourself or using a pseudonym in certain circumstances. 
  • Right to access: You have the right to request access to your personal information. 
  • Right to stop unwanted direct marketing: You have the right to request we stop unwanted direct marketing to you. 
  • Right to correct: You have the right to ask us to rectify personal information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete.
  • Right to file a complaint: You have the right to file a complaint with us, if we do not respond to your complaint within 30 days, you can lodge a complaint with the  Office of the Australian Information Commissioner (OAIC), here

DO NOT TRACK

We do not respond to Do Not Track (DNT) requests. Do Not Track is a preference you can set in your web browser to inform Website and mobile applications that you do not want to be tracked. You can enable or disable Do Not Track by visiting the Preferences or Settings page of your web browser. 

INFORMATION SECURITY 

We implement and maintain reasonable security measures, such as access controls and encryption, to protect the personal information that we collect and maintain from accidental loss, unauthorized access, destruction, use, modification, or disclosure. All information you provide to us is stored on our secure servers behind firewalls. Any payment transactions will be encrypted using SSL technology.  

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our EOS Web Properties or any third-party sites. No security measure or modality of data transmission is 100% secure, and we are unable to guarantee the absolute security of the personal information we have collected from you. 

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our EOS Web Properties, you are responsible for keeping this password confidential. We ask you not to share your passwords with anyone. We urge you to be careful about giving out information in public areas of our EOS Web Properties like message boards. The information you share in public areas may be viewed by any user.

Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on our EOS Web Properties or any third-party sites.

DATA RETENTION

We retain your personal information for as long as necessary to fulfill the purposes for which the information was collected.  We retain consumer data for as long as the account is active or in accordance with any agreements between EOS Worldwide and the customer unless it is required by law or a regulation to maintain the data for longer. We may also maintain retain some of your personal information for trust and safety purposes or to defend against a legal claim. If you request to delete your data, barring any exceptions, we will delete your data within thirty (30) days of request by a current or former customer or in accordance with customer agreements. 

CHILDREN’S PRIVACY 

Neither our EOS Web Properties nor our products and services are intended for individuals under sixteen (16) years of age.  If you are under sixteen (16) years of age, do not use or provide any information on our EOS Web Properties or through any of its features, including your name, address, telephone number, or email address. If we learn that we have collected or received personal information from individuals under sixteen (16) years of age, we will delete the personal information. If you believe we have personal information on individuals under sixteen (16) years of age, please contact us at the contact information provided below.  California residents under sixteen (16) years of age may have additional rights regarding the collection and sale of their personal information. CHANGES TO THIS PRIVACY NOTICE

This Privacy Notice is subject to change. When we make changes, we will post the new Privacy Notice on this page, and we will indicate the date the changes go into effect. We encourage you to review this page frequently and review the Privacy Notice for any changes. If we make changes that materially affect your privacy rights we will announce those changes by email notification to you or through similar means. If you keep using the EOS Web Properties or our products or services after we notify you, we will take this to mean that you accept the change for any new data we collect. If required by law, we will ask you to actively acknowledge your acceptance.
